Terms of Service

1. Nature of the Service

Awundra is a curated platform for submitting, hosting, and showcasing cinematic AI-generated video. The platform is currently in an early stage and may evolve, including its features, curation standards, and business model, at any time. By using Awundra, you agree to these Terms. If you do not agree, do not use the platform.

2. Eligibility

You must be at least 18 years old to create an account or submit content. By using Awundra, you represent that you meet this requirement. If you are under 18, do not use the platform.

3. User Accounts

Some features, including submitting content and participating in voting, require an account. You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. Notify us immediately at kent@awundra.com if you believe your account has been compromised.

4. Content Submissions & Creator Responsibility

You are solely responsible for all content you submit. Awundra does not verify ownership, legality, or accuracy of any submission. By submitting content, you represent and warrant that you hold all rights, licenses, consents, releases, and permissions necessary for that content, including, where applicable:

  • Copyright: you own the underlying work or have a license sufficient to submit, host, display, and promote it.
  • Music and audio: you have cleared any musical compositions, recordings, samples, sound effects, or other audio used in the film (both composition and master, where applicable).
  • Trademarks, brands, and logos: your film does not depict third-party trademarks, brand identifiers, or logos in a way that requires permission you have not obtained.
  • Real-person name, image, likeness, and voice: your film does not depict, reference, or impersonate any identifiable real person, living or recently deceased, without that person's explicit consent. This includes AI-generated or synthesized likenesses, voice clones, performance captures, and any output that a reasonable viewer would associate with a specific real individual.
  • Performances: any actor, performer, narrator, or contributor whose work appears in the film has authorized that use.
  • Privacy and publicity rights: your film does not violate the privacy or publicity rights of any individual.
  • Third-party characters and IP: recognizable characters, settings, or other protected creative elements are either original, properly licensed, or used within a clearly applicable legal exception.
  • AI-generated output: you have reviewed every frame of the generated result and take full responsibility for it, including any training-data artifacts, recognizable likenesses, brand marks, copyrighted characters, or protected elements that appear unexpectedly.
  • Legal compliance: your content complies with all applicable laws and does not constitute defamation, harassment, fraud, obscenity, or incitement.

Submitting a film does not transfer this responsibility to Awundra. You agree that Awundra is entitled to rely on these representations and to act on them, including by removing content and suspending accounts, if it later appears they were inaccurate.

5. Prohibited Content

The following content is strictly prohibited and will result in removal and potential account termination:

  • Content that infringes copyright, trademark, or other intellectual property rights.
  • Content that depicts real individuals in a false, defamatory, sexually explicit, or otherwise harmful way, including AI-generated deepfakes.
  • Content that constitutes harassment, threats, or targeted abuse of any person.
  • Sexually explicit content or content involving minors in any harmful context.
  • Content designed to deceive, defraud, or manipulate viewers.
  • Spam, promotional content unrelated to the platform's purpose, or bulk submissions.
  • Content that violates any applicable law or regulation.

Accounts that submit prohibited content may be permanently banned.

6. Acceptable Use

In addition to the content rules above, you agree not to:

  • Scrape, harvest, or bulk-download content, user data, or any other material from the platform.
  • Access the platform through bots, crawlers, or other automated means without Awundra's prior written consent.
  • Probe, scan, or test the vulnerability of the platform, or circumvent any security or access-control measure, including rate limits and authentication.
  • Interfere with the operation of the platform, including by overloading, flooding, or spamming it, or by submitting content or requests designed to disrupt the service.

Awundra may suspend or terminate accounts engaged in any of these activities.

7. License Grant

By submitting content to Awundra, you grant Awundra a non-exclusive, worldwide, royalty-free license to host, store, display, stream, reproduce, and promote your content on the platform and in connection with marketing Awundra, including the right to sublicense to the service providers Awundra uses to operate the platform (such as hosting, transcoding, and content-delivery providers), solely as necessary to provide the service. You retain full ownership of your content. This license terminates when your content is removed from the platform, except to the extent Awundra has already distributed or promoted it.

8. No Guarantee of Hosting, Ranking, or Exposure

Submission does not guarantee acceptance, publication, ranking, or visibility on the platform. Awundra curates content at its sole discretion. Accepted content may be ranked, featured, or surfaced using algorithmic or editorial methods that are not guaranteed to be stable or consistent. Awundra reserves the right to de-list, re-rank, or remove content at any time without notice or explanation.

9. Content Moderation & Removal

Awundra may review, reject, remove, disable access to, restrict, de-list, or refuse to host any content at its sole discretion, for any reason, including but not limited to quality, curation fit, policy compliance, legal risk, third-party rights concerns, or credible user reports, without notice or obligation to provide an explanation. Awundra is not obligated to retain any content submitted by users.

Reports submitted through the in-app Report button or by email do not automatically result in removal. Awundra reviews each report at its discretion, may investigate further, may request additional information from the reporter or the creator, and may take or decline to take action based on its own assessment. Accounts may be suspended or terminated for violations of these Terms, repeated rights concerns, or any conduct Awundra reasonably determines to be harmful to the platform or its community.

10. Competition & Prizes

Awundra may operate film selection seasons, audience award programs, or other prize programs from time to time. No such program is currently running. When a program is active, its Official Contest Rules are published on the platform, are incorporated by reference, and govern with respect to prize-specific matters in the event of any conflict with these Terms. Awundra makes no guarantee that any submission will be selected for, shortlisted in, or recognized by any such program.

11. DMCA Takedown Policy

Awundra respects intellectual property rights and complies with the Digital Millennium Copyright Act (17 U.S.C. § 512). Awundra has a designated copyright agent registered with the U.S. Copyright Office (Registration #1075472), reachable at kent@awundra.com or by mail at:

If you believe content on Awundra infringes your copyright, submit a written notice to that address that includes:

  • Identification of the copyrighted work you claim has been infringed.
  • The URL or specific location of the allegedly infringing material on Awundra.
  • Your name, address, telephone number, and email address.
  • A statement that you have a good faith belief that the use is not authorized by the copyright owner, its agent, or the law.
  • A statement made under penalty of perjury that the information in your notice is accurate and that you are the copyright owner or authorized to act on their behalf.
  • Your physical or electronic signature.

Upon receipt of a valid notice, Awundra will remove or disable access to the identified content promptly and will notify the user who submitted it.

Counter-notice. If your content was removed and you believe the removal was a mistake or misidentification, you may submit a written counter-notice to the same address that includes: (a) identification of the removed material and its location before removal; (b) a statement, under penalty of perjury, that you have a good-faith belief the material was removed as a result of mistake or misidentification; (c) your name, address, and telephone number; (d) a statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located (or, if outside the United States, any judicial district in which Awundra may be found) and that you will accept service of process from the person who filed the original notice or their agent; and (e) your physical or electronic signature. Unless the original complainant notifies Awundra that they have filed a court action seeking to restrain the alleged infringement, removed content may be restored within 10–14 business days of receiving a valid counter-notice.

Repeat infringers. Awundra will terminate, in appropriate circumstances, the accounts of users determined to be repeat infringers.

12. Rights Complaints (Non-Copyright)

If you believe content on Awundra raises a rights or safety concern other than copyright, for example, unauthorized use of your name, image, likeness, voice, or performance; impersonation; an AI-generated or synthesized depiction of you; a deepfake; or a violation of your privacy or publicity rights, you can:

  • Use the Report button on the film page, or
  • Email kent@awundra.com with the URL of the film, the nature of the concern, and any context that helps Awundra evaluate the report (for example, evidence that you are the person depicted, or that you have authority to act on their behalf).

Reports do not automatically result in removal. Awundra reviews each report at its discretion and may remove, restrict, disable access to, or leave the content in place based on its own assessment of the facts, the rights involved, the public interest, and applicable law. Awundra may follow up for additional information and may share relevant details from the report with the creator so they can respond. Submitting a knowingly false or bad-faith report may itself be a basis for action against the reporter's account.

13. Privacy

Your use of Awundra is also governed by the Privacy Policy, which describes what data the platform collects and how it is used, and which is incorporated into these Terms by reference.

14. Indemnification

You agree to indemnify, defend, and hold harmless Awundra and its operators, affiliates, and representatives from and against any claims, liabilities, damages, losses, and expenses, including legal fees, arising out of or related to: (a) your use of the platform; (b) content you submit; (c) your violation of these Terms; or (d) your violation of any third-party rights, including intellectual property rights or rights of publicity. Awundra reserves the right to assume exclusive defense and control of any matter subject to indemnification by you, at your expense.

15. Third-Party Content & Embeds

Awundra may display embedded content from third-party providers such as YouTube or Vimeo. Those services are governed by their own terms and privacy policies. Awundra does not control and assumes no responsibility for third-party content or services.

16. Limitation of Liability

Awundra is provided "as is" without warranties of any kind, express or implied. To the fullest extent permitted by applicable law, Awundra is not liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, revenue, or opportunity, arising from your use of or inability to use the platform, regardless of whether Awundra has been advised of the possibility of such damages. Awundra's total liability for any claim arising out of these Terms will not exceed the amount you paid to use the platform in the twelve months preceding the claim, or $100, whichever is greater.

17. Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of Texas, without regard to its conflict of law principles.

Informal resolution first. Before filing any claim, you agree to contact Awundra at kent@awundra.com with a written description of the dispute and to attempt in good faith to resolve it informally for at least 30 days.

Binding arbitration. Except as provided below, any dispute arising out of or relating to these Terms or your use of Awundra that is not resolved informally will be resolved by binding arbitration on an individual basis, administered by the American Arbitration Association under its Consumer Arbitration Rules, rather than in court. The arbitration will be conducted in Texas or, at your election, remotely.

Class-action waiver. You and Awundra each waive the right to participate in a class action, class-wide arbitration, or other representative proceeding. Disputes may be brought only in an individual capacity.

Small-claims carve-out. Either party may bring an individual claim in small-claims court instead of arbitration, if it qualifies.

For any matter not subject to arbitration, you consent to the exclusive jurisdiction of the state or federal courts located in Texas, and you waive any right to a jury trial in any such proceeding.

18. Assignment

Awundra may assign these Terms, in whole or in part, in connection with a merger, acquisition, reorganization, or sale of assets, or by operation of law. You may not assign or transfer these Terms or your account without Awundra's prior written consent; any attempted assignment without consent is void.

19. Force Majeure

Awundra is not liable for any delay or failure to perform caused by events beyond its reasonable control, including natural disasters, war, terrorism, labor disputes, government action, internet or infrastructure failures, or outages of third-party services the platform depends on.

20. Severability

If any provision of these Terms is held invalid or unenforceable, that provision will be enforced to the maximum extent permissible and the remaining provisions will remain in full force and effect.

21. Entire Agreement

These Terms, together with the Privacy Policy and, when a prize program is active, its published Official Contest Rules incorporated by reference, constitute the entire agreement between you and Awundra regarding the platform and supersede any prior agreements or understandings on that subject.

22. Changes to These Terms

Awundra may update these Terms at any time. Changes will be reflected by an updated date at the top of this page. Continued use of the platform after changes are posted constitutes acceptance of the updated Terms. For significant changes, we may notify registered users by email.
